Data Privacy Statement on the processing of personal data during application procedures

With this information sheet, we (kfzteile24 GmbH) would like to inform you as an applicant about how your personal data will be collected, processed and stored during application procedures.

The European General Data Protection Regulation (“GDPR”) and the Federal Data Protection Act (“BDSG”) aim, among other things, to inform people who are the data subjects of data processing operations (including you, as part of an application procedure) about the extent to which their personal data will be processed.

Personal data” means data that refers to you personally or that allows conclusions to be drawn about your identity (such as your name, your date of birth, or your cell phone number). In the following, this will be abbreviated to “data”. But it will always mean personal data. Hereafter, “data processing” will mean using data in any way, including collecting or storing it.

In the following, we will address the transparency requirements of the GDPR and the BDSG in connection with the data processed as part of your application procedure.

If you have questions or requests regarding the protection of your data, please send a letter by mail to the aforementioned address, or send an email to: datenschutz@kfzteile24.de.

3. Data that we process

During our application procedure, we will collect personal data about you that you will send to us. What follows is an overview of which data we will process for what purpose and on what legal basis, and how long we will store it.

3.1 Data that we collect from you

During your application, we will process the data obtained from the contact made with you and the job interviews held with you. Examples of this data include:

  • Form of address

  • First and last names

  • Address

  • Email address

  • Phone number

  • Application letter (position sought, possibly suggested salary)

  • Curriculum Vitae (data about your qualifications, professional experience and training, and possibly: family status, driver’s license class, disabled status, religious denomination and ideology, affiliation with a workers’ organization, hobbies and leisure activities)

  • References, if applicable

  • Photo, if applicable

  • In-house records from job interviews with you, if applicable

3.2 Data that we collect from third parties

In certain situations, your data will also be collected from third parties. These primarily include cases in which we view your profile on professional social networks such as Xing and LinkedIn, and insofar as we obtain your data and application documents from a personnel consultant or recruitment agencies.

For applications, we use the applicant management software of Recruitee B.V., Keizersgacht 313, 1016 EE Amsterdam, Netherlands (“Recruitee”), with whom we have entered into a contract on commissioned data processing. If you send us personal data via Recruitee (in application documents, for example), the information you enter and the contact information indicated there will be stored for the purpose of selecting applicants to possibly establish an employment relationship.

4. Purpose of processing

We will process all the data mentioned above to carry out the application procedure and to determine whether we can offer you the position for which you applied and hire you as an employee.

If you have given us your consent to consider your application and associated data for other positions, we will process your data to determine whether we can offer you a position other than the one for which you applied and hire you as an employee.

If you accept our offer to hire you as an employee in our company, we will store your data in the following to carry out the employment relationship with you. In this case, you will receive additional information about the processing of your data in an employment relationship with kfzteile24 as soon as you commence that relationship.

The legal basis for the aforementioned data processing is Art. 6(1)(1)(b) and 88 GDPR as well as Section 26(1)(1) BDSG.

If the data is included in the “special categories of personal data”, such as those pertaining to your health, that you disclose to us (such as information about your status as a severely disabled person), the data will be processed on the legal basis of Articles 6(1)(1)(b), 9, and 88 GDPR, as well as Section 26(3)(1) BDSG.

If you have given us your consent to consider your application and associated data for additional positions, the processing will be based on that consent, and therefore on the legal basis of Articles 6(1)(1)(a) and 88 GDPR as well as Section 26(1)(1) BDSG.

5. Recipients of the data

In certain cases, we must forward part of your data that we process as part of the application procedure to agencies and people outside our company. We will forward data to the following groups of recipients, arranged by category:

  • Service providers that process personal data (“commissioned data processors”).

  • Lawyers who work for kfzteile24.

  • Recruitment agencies who work for kfzteile24, provided they sent us your application.

  • Personnel consultants who work for kfzteile24, provided they sent us your application.

If we are legally obligated to forward your data, or your data is necessary for the work of the lawyers, personnel consultants and recruitment agencies who work for us, we will forward your data to those parties as needed.

Service providers who work on our behalf sometimes process data for us. If this is the case, we will enter a “contract on commissioned data processing” with the service provider, under which we will obligate that service provider to process the data carefully and according to our instructions. Under such a contract, the service provider will process the data according to our specifications and on our behalf, and will therefore be called a “commissioned data processor.”

Apart from that, access to your personal data will be given only to our company employees who must view that data as part of the application procedure, particularly the personnel department and the decision-makers in the department in question.

6. Duration of storage

As a general principle, we will store your data as long as it is needed for the application relationship. If you have applied exclusively for a specific position (and have not given us your consent to consider your application and associated data for other positions) and you receive a notice of rejection from us for that position, we will keep your data for a maximum of six months after you receive such notification, unless we must store it for longer on the basis of legal grounds or statutory obligations.

If you have given us your consent to consider your application and associated data for other positions, or for an additional period, we will process your data for longer than six months.

If you accept our offer to hire you as an employee in our company, we will store your data for the duration of the employment relationship with you. In this case, you will receive additional information about the processing of your data in an employment relationship with kfzteile24 as soon as you begin that relationship.

7. Your rights regarding data processing at kfzteile24

Under applicable statutory requirements, you have the following statutory rights to data protection:

  • Right of access to information (Art. 15 GDPR, Section 34 BDSG)

  • Right to erasure (Art. 17 GDPR, Section 35 BDSG)

  • Right to rectification (Art. 16 GDPR)

  • Right to restriction of processing (Art. 18 GDPR)

  • Right to data portability (Art. 20 GDPR)

To assert your rights described here, you may at any time turn to the contact information specified under “Controller and contact information”.

You also have a right to file a complaint at any time with the data protection supervisory authority responsible for us: Die Berliner Beauftragte für Datenschutz und Informationsfreiheit, Friedrichstr. 219, 10969 Berlin. You may assert this right with a supervisory authority in the Member State of your place of residence or workplace, or the location of the alleged breach.

8. Rights to withdrawal and objection

Under Art. 7(3) GDPR, you may at any time withdraw consent you have granted to us. If you do so, from that point on we may no longer continue any data processing based on that consent. Withdrawing that consent will not affect the legality of any processing that occurred based on that consent before it was withdrawn.

If we are processing your personal data based on legitimate interests under Art. 6(1)(1)(f) GDPR, you may object to that processing pursuant to Art. 21 GDPR, if grounds exist that relate to your particular situation or if the objection is directed at processing for direct marketing purposes. In the latter case, you have a general right to object, which we will honor without requiring you to give us reasons.

If you wish to assert your right to object or withdraw consent, a notification sent to the contact information specified under “Controller and contact information” will suffice (no official form is required).

9. Amendments to the data privacy statement

We occasionally update this data privacy statement (if we adjust our website or the statutory specifications change, for example).
